4. Memberships, Billing, and Cancellations

While this Site serves as a portal for payments, your physical access to the gym is governed by a separate Membership Agreement signed at the time of purchase.

Pricing: Prices for memberships and drop-in passes are subject to change. We will provide notice of price changes on the Site.

Payments: By providing a payment method, you authorize APX Training Systems to charge the applicable fees (including recurring monthly fees, if selected).

Refunds: Refunds are governed by the specific terms of your Membership Agreement. Generally, services already rendered and initiated monthly dues are non-refundable unless required by law.

5. Intellectual Property

All content on this Site, including text, graphics, logos (specifically the APX Training Systems name and logo), images, and software, is the property of APX Training Systems or its content suppliers and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works from this content without express written permission.

By providing your phone number and opting in to receive SMS messages from APX Training Systems, you agree to the following terms:

1. Program Description

When you submit an inquiry regarding our personal training programs, fitness assessments, or membership options, you are consenting to receive recurring automated and manual text messages. These messages are designed to:

Follow up on your initial program inquiry.

Schedule your introductory session or consultation.

Provide updates on limited-time promotions or gym events.

2. Message Frequency

Message frequency varies based on your interaction with us. Typically, leads can expect 10 messages per month during the initial follow-up period.

3. Rates and Charges

APX Training Systems does not charge for our SMS service. However, message and data rates may apply depending on your mobile carrier and service plan.

4. Opting Out

You can cancel the SMS service at any time. Just text STOP. After you send the SMS message STOP, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us.

6. Privacy & Data

We value your privacy. Your mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Carrier Liability Disclaimer

Liability of Mobile Carriers: Mobile carriers (including, but not limited to, AT&T, T-Mobile, and Verizon) are not liable for delayed or undelivered messages. APX Training Systems and all mobile carriers operate on a "best-effort" basis for the delivery of SMS and MMS communications. We do not guarantee the delivery of any messages and shall not be held responsible for any delivery failures caused by network issues, device compatibility, or service interruptions.

Message & Data Rate Disclosure

Cost of Participation: APX Training Systems does not charge a fee for our text messaging service. However, message and data rates may apply for any messages sent to you from us and to us from you. These charges are billed by your mobile service provider and are subject to the terms of your individual mobile plan.

If you have questions about your text plan or data plan, it is best to contact your wireless provider directly. APX Training Systems is not responsible for any charges incurred as a result of using this service.
